Surrogacy

Surrogacy is often a preferred route for LGBT+ individuals and couples wishing to start a family as it means one parent has a genetic link to their child. Surrogacy is legal in the UK but it's illegal to advertise for surrogates. No financial benefit other than reasonable expenses can be paid to the surrogate. The baby is not legally the intended parent/s until a parental order has been issued after the child's birth. Until this order is issued the surrogate has the right to keep the baby. However, this is a sensitive matter and a full open discussion needs to take place between the surrogate and intended parents to ensure all needs are met.

Advertising for a surrogate is illegal in the UK as is matching surrogates and intended parent(s) together. As such, meeting potential surrogates can prove difficult. The law stipulates that intended parent(s) must both be resident in the UK and, if in a couple, be living together. One intended parent must be genetically related to any baby born through surrogacy, so they must be able to use their own embryos, or only use donor sperm OR donor eggs. Double donation is not allowed.”
